Consumer Duty
We are committed to fair customer outcomes and to meeting current FCA expectations under the Consumer Duty. This includes taking account of customer needs, supporting understanding, and providing appropriate support throughout the customer journey.
Consumers can be confident that they are dealing with firms where the fair treatment of customers is central to the corporate culture. Products and services marketed and sold in the retail market are designed to meet the needs of identified consumer groups and are targeted accordingly.
Consumers are provided with clear information and are kept appropriately informed before, during, and after the point of sale.
Consumers do not face unreasonable post-sale barriers imposed by firms to change product, switch provider, submit a claim, or make a complaint.
Consumers are provided with products that perform as firms have led them to expect, and the associated service is of an acceptable standard and as they have been led to expect.
Where consumers receive advice, the advice is suitable and takes account of their circumstances.
The Consumer Duty Principle
Effective from 31st July 2023, the Consumer Duty introduces a new Principle that sets a higher standard of consumer protection across financial services, requiring firms to act to deliver good outcomes for retail customers.
Principle 12: A firm must act to deliver good outcomes for retail customers.
The Consumer Duty also introduces Cross-Cutting Rules, which articulate the standards of conduct expected by the FCA under Principle 12 to ensure good outcomes are delivered.
Firms must:
Act in good faith toward retail customers. Avoid foreseeable harm to retail customers. Enable and support retail customers to pursue their financial objectives.
In addition to the TCF outcomes, the FCA has identified four Consumer Duty outcomes that the Bank must act to deliver. These outcomes relate to:
- Products and services
- Price and value
- Consumer understanding
- Consumer support
The Bank monitors its approach to customer outcomes and reviews its systems and controls in light of regulatory requirements and evolving good practice.
